Platform Terms of Use

All rights to the Platform, which is operated by TVN Medya ve Yapım A.Ş. (the "Company"), registered under tax identification number 883 112 86 01 with the Maslak Tax Office and located at "Yeşilce Mah. Ulubaş Cad. No:23/3 Kağıthane Istanbul," belong to the Company. Use of the Platform by members ("Member") is subject to the following terms and conditions. Please carefully read the following terms of use ("Terms of Use") before using the Platform.

Luvi brings together all creative processes—from visual generation to video design and advanced editing—within a single, distinguished artificial intelligence ecosystem. Elegantly merging creativity with technology, Luvi is a platform that transforms your ideas into refined, compelling, and professional content.

By accessing, viewing, or using the Platform, you acknowledge that you have read, understood, and accepted the terms and conditions set forth in these Terms of Use.

The Platform may be visited by anyone, provided it is used in accordance with the Terms of Use and applicable legislation. However, since taking advantage of the features offered by the Platform requires membership, the functions of the Platform that are available without membership are limited.

LUVI is an artificial intelligence-based digital creativity platform offering visual generation, video creation, editing, and creative content development tools. By combining multiple AI models in a single, seamless experience, the Platform aims to accelerate and simplify users' creative workflows. Platform outputs are generated through automated systems and are not manually reviewed by the Company in advance.

In order to benefit from the Platform's AI-powered products, the User must create a membership account. The User acknowledges and undertakes that the information provided during the account creation process is accurate, complete, and up to date, and that any changes to such information will be updated without delay. Maintaining the confidentiality and security of account information and login credentials is exclusively the User's responsibility. All transactions carried out through the account shall be deemed to have been performed by the User unless proven otherwise, and any legal and financial liability arising from such transactions belongs to the User. The Company reserves the right to temporarily suspend or permanently terminate the User's account without prior notice in the event of a breach of the Terms of Use, unlawful use, activities threatening the system security of the Platform, or suspicion of abuse or fraud.

No element of the Platform, including but not limited to the content published on the Platform, may be published in writing, orally, and/or electronically or in any other form/medium on other websites and/or other platforms without the Company's permission, nor may it be used in a manner that directly and/or indirectly competes with the Company.

The Company shall not be held directly and/or indirectly liable in any way for any damages suffered or that may be suffered by third parties due to activities carried out by Members in violation of these rules. The Company reserves the right of recourse against the relevant Member for any claims from third parties in this regard and for damages arising from the Member's failure to fulfil the obligations set forth herein.

Copying the information and software used in the design, content, and database of the Platform or using the Platform for purposes other than its intended purpose is prohibited. Unauthorized copying, distribution, or processing of images, text, files, and other data on the Platform is strictly prohibited.

The Member acknowledges that access to the Platform may be temporarily blocked for the implementation of improvements and other changes to the Platform.

The Platform may contain links to or references to other websites that are not under the Company's control. The Company is not responsible for the content of such sites or the other links they contain, and the provision of such links and references does not imply endorsement of third parties or any guarantee in that regard.

Prohibited Activities

The following activities by Members are strictly prohibited: (i) any attempt that may threaten the security of the Company's software, portals, and interfaces, or that may prevent and/or hinder their operation or other users' use thereof; (ii) imposing a disproportionate load on the software, portals, and interfaces in a manner that would produce such results; (iii) unauthorized access to the Platform's source code or the Company's systems, copying, deleting, modifying such information and content, or making attempts to that effect, and/or any activity that threatens the security or disrupts the operation of the Platform; (iv) copying, sharing, or using all or part of any content on the Platform without the Company's prior written consent through automated programs, web crawlers, or similar "screen scraping" software; (v) using or attempting to use other software that would prevent and/or hinder the operation of the Company's software, portals, and interfaces, attempting to integrate such software with those provided by the Company, or disrupting, damaging, reverse engineering, attacking, engaging, or otherwise interfering with the operation of any software, hardware, and servers, or attempting to gain access to the Company's servers.

All legal, administrative, and criminal liability arising from the use of the Platform and from the transactions carried out by the Member within the scope of the Platform belongs solely and exclusively to the Member.

In the event that free-entry fields are made available while the Member uses the Platform, the Member acknowledges and undertakes that the content shared in such fields shall not include statements containing special categories of personal data, and shall not contain statements that involve criminal elements, are contrary to public morality and/or legislation, or infringe upon the rights of third parties.

The Company may suspend or terminate the Platform and/or these Terms of Use, either for a definite or indefinite period, at any time.

The Company reserves the right to change, reorganize, or discontinue the publication of the content, digital services, terms of use, and information provided on the Platform without prior notice.

User Obligations

The User agrees to act in compliance with the law and applicable legislation while using the Platform. In this regard, the User acknowledges and undertakes: not to generate content that is contrary to the Turkish Penal Code and related legislation; not to create content containing hate speech, violence, obscenity, or otherwise illegal in nature; not to produce unauthorized deepfake content depicting real individuals; not to infringe upon the copyrights, trademarks, patents, designs, and other intellectual property rights of third parties; not to attempt unauthorized access to the Platform's systems; not to engage in reverse engineering; not to use the Platform for the purpose of developing competing products or services; and not to interfere with the system through automated bots, scraping, data mining, or similar methods.

In order to fully benefit from the Platform, the User must create a membership account. Membership may only be established by natural persons who have reached the age of 18 and by legal entities duly incorporated. The User acknowledges, represents, and undertakes that all information provided during membership registration is accurate, up to date, and complete, and that any changes to such information will be promptly updated. All legal and administrative liability arising from the provision of inaccurate, incomplete, or false information belongs to the User.

The User is obligated to keep account information and passwords confidential. All transactions carried out through the account shall be deemed to have been performed by the User. Sharing, transferring, or permitting the use of the account by third parties is prohibited. In the event that unauthorized use of the account is detected, the User is obligated to immediately notify the Company.

The Company reserves the right to temporarily suspend or permanently terminate the User's membership in the event of a breach of the Terms of Use, detection of unlawful activities, activities that jeopardize system security, or suspicion of misuse. In such cases, the User may not assert any rights or claims against the Company.

In the event that membership is terminated by the User, the account deletion process is irreversible, and unused credits or subscription fees shall not be refunded, except where required by applicable legislation.

The Member may not transfer their created accounts, usernames and passwords, or membership profiles to any other user or permit their use by third parties under any circumstances.

The Member agrees to keep confidential all commercial, financial, legal, technical, or other information of any nature obtained directly or indirectly in connection with the Platform and related services, and not to disclose such information to third parties without the Company's prior written consent.

The Company may collect the Member's information in a database for purposes such as the performance of services offered through the Platform, creation of user profiles, conducting analyses, maintaining usage statistics, and service improvement, and may process and store such data in compliance with Law No. 6698 on the Protection of Personal Data and related secondary regulations. The Company may also share such information with third parties and institutions as required by Platform services or where necessary.

This confidentiality provision shall remain in effect indefinitely, even after the termination of the Terms of Use.

The Company is the owner or licensee of the overall appearance and design of the Platform and all information, images, Company trademarks and domain names, logos, icons, demonstrative, written, electronic, graphic, or machine-readable technical data, computer software, sales systems, business methods, and business models, including all materials presented on the Platform, and the intellectual and industrial property rights related thereto, and the Materials are under legal protection. No Material on the Platform may be modified, copied, reproduced, translated into another language, republished, uploaded to another computer, mailed, transmitted, presented, or distributed without prior permission and attribution.

The User explicitly acknowledges that all visual, descriptive, and audio materials provided by the User are being used in compliance with all applicable legislation; that the User shall not infringe upon the intellectual and industrial property rights of any third party; and that the User is exclusively responsible for all third-party claims in this regard.

The legality of all data, text, images, videos, audio recordings, prompts, and other content uploaded to the Platform by the User is exclusively the User's responsibility. The User acknowledges that they hold the necessary economic and moral rights, licenses, and usage authorizations over the content uploaded to the Platform.

Content generated by artificial intelligence systems through the Platform ("Outputs") is produced through automated algorithms, and it is possible that content of a similar or identical nature may be generated for other users. The Company does not warrant or guarantee that the generated content is entirely original, free from the intellectual and industrial property rights of third parties, suitable for commercial use, or fit for a particular purpose. The User is obligated to conduct the necessary legal and technical reviews before using, publishing, or placing AI-generated content into commercial circulation.

The Platform's software, source code, algorithms, interface, design, database structure, trademarks, logos, and all other components are protected under the applicable legislation. Without the Company's prior written consent, the Platform may not be copied, reproduced, processed, distributed, made available to the public, used for commercial purposes, subjected to reverse engineering, or otherwise reproduced.

The Company shall not be liable for any direct or indirect damages that may arise from accessing the Platform or from the use of the Platform or the information, other data, programs, etc. contained therein. The Company accepts no liability for breach of contract, tort, negligence, or other causes resulting in: interruption of service, errors, omissions, interruptions, deletions, losses, delays in operations or communications, computer viruses, failures in telecommunications lines, communication errors, theft, destruction, or unauthorized access to, modification of, or use of records.

The Platform and related content are provided "as is," and the Company makes no warranties of any kind, whether express or implied, including but not limited to implied warranties, merchantability, and fitness for a particular purpose. All risk related to the use or performance of the services belongs to the Member.

The Company may change the party to these Terms of Use, in whole or in part, at any time without notice and/or may transfer the rights and authorities contained herein. However, the Member may not transfer their obligations under these Terms of Use to any third party. Any such transfer shall be null and void.

These Terms of Use shall enter into force on the date they are published by the Company on the Platform. The Company may amend the provisions of these Terms of Use at any time, and such amendments shall come into direct effect upon the date they are published on the Platform. We recommend that you review these Terms of Use at regular intervals.

The Courts and Enforcement Offices of Istanbul shall have jurisdiction over the resolution of any disputes that may arise from the application or interpretation of these Terms of Use.
